1. Who are we?

SkiMatcher B.V. in formation ("we", "us" or "SkiMatcher") is responsible for the processing of personal data as set out in this privacy policy.

We offer an AI-powered advisory tool via our websites www.skimatcher.nl and www.skimatcher.com through which users receive personalized winter sports recommendations. In addition, users can request a non-binding quote from accommodations.

We handle personal data carefully and responsibly, in accordance with the General Data Protection Regulation (GDPR) and other applicable laws and regulations.

2. What Data Do We Process?

2.1 Use of the Advisory Tool (without account)

Data we process: Preferences, experience level, travel party, budget and travel period (as entered in the advisory tool).

Purpose: Generating customized winter sports recommendations.
Legal basis: Consent (Art. 6(1)(a) GDPR). You actively give consent by using the advisory tool.
Retention period: Data is only stored in your browser (session storage/cookies) and not on our servers, unless you choose to create an account.

2.2 Registration and Account

Data we process: Name, email address, password (stored encrypted), user preferences and account settings.

Purpose: Managing your account, storing your advice history and enabling future personalization.
Legal basis: Performance of a contract (Art. 6(1)(b) GDPR).
Retention period: As long as your account is active. After deletion of your account, data will be permanently deleted within 30 days.

2.3 Booking Requests

Data we process: Name, email address, phone number, request details (number of people, desired period, special requests) and preference information from the advisory tool.

Purpose: Forwarding your booking request to the accommodation(s) of your choice.
Legal basis: Performance of a contract (Art. 6(1)(b) GDPR).
Retention period: Maximum 2 years after the travel date or until you request deletion.

2.4 Newsletter

Data we process: Email address and preferences (if provided).

Purpose: Sending our newsletter with winter sports tips, offers and news.
Legal basis: Consent (Art. 6(1)(a) GDPR).
Retention period: Until you unsubscribe via the unsubscribe link in the newsletter or via your account settings.

2.5 Contact Forms and Customer Service

Data we process: Name, email address, phone number (if provided) and the content of your message or question.

Purpose: Answering questions, handling complaints and providing support.
Legal basis: Legitimate interest (Art. 6(1)(f) GDPR).
Retention period: Maximum 2 years after the last contact.

3. Disclosure to Third Parties

We do not sell your data to third parties.

In the case of a booking request, we pass on your data (name, email address, phone number and request details) to the chosen accommodation. At that point, the accommodation itself becomes the controller of your personal data.

For the technical operation of our websites, we use external service providers, such as hosting providers and email service providers. They process personal data exclusively on our behalf and under a processor agreement.

We use Google Analytics to collect website statistics. Data may be processed by Google LLC in the United States (outside the European Economic Area). We have taken appropriate safeguards for this, including entering into EU Standard Contractual Clauses with Google and enabling IP anonymization. We request your consent via our cookie banner for the use of Google Analytics.

In exceptional cases, we may be obliged to provide personal data to competent authorities, for example on the basis of legislation or a court order.

4. Your Rights

You have the right to:

If the processing is based on your consent, you can withdraw it at any time. This does not affect the lawfulness of the processing before the withdrawal.

To exercise your rights, you can contact us via info@skimatcher.com. We may ask you to verify your identity. We will respond within one month; for complex requests, this may be extended by a maximum of two months.

You also have the right to lodge a complaint with the Dutch Data Protection Authority (www.autoriteitpersoonsgegevens.nl).

5. Security

We take appropriate technical and organizational measures to protect your personal data against loss, misuse and unauthorized access. These measures include SSL encryption for data transmission, access security to systems and databases, and security updates and system monitoring.

Despite these measures, we cannot guarantee absolute security. If a data breach occurs that is likely to pose a risk to your rights and freedoms, we will report this to the Data Protection Authority within 72 hours and, if legally required, also to you.

6. Cookies

We use cookies and similar technologies.

Necessary cookies: These cookies are essential for the operation of the website, such as sessions, security and remembering cookie preferences. These cookies are placed on the basis of our legitimate interest in technical necessity.

Functional cookies: These cookies improve the user experience by remembering preferences.

Analytical cookies: We use Google Analytics to gain insight into website usage. This includes collecting data about visited pages, click behavior and session duration. This data is processed anonymously and may end up outside the EEA. We have taken appropriate safeguards for this via EU Standard Contractual Clauses.

For functional and analytical cookies, we request consent in advance via our cookie banner. You can always change your preferences via your browser settings or via the cookie banner on our website.

7. Links to External Websites

Our websites may contain links to external websites of accommodations, ski resorts and partners. We are not responsible for their privacy policy or content and recommend that you read the privacy statement of those websites before providing personal data.

8. Minors

Our services are intended for persons aged 16 and over. We do not knowingly collect personal data from persons under 16 without parental consent. If you suspect that we have collected data from a minor, we ask you to contact us so that we can delete it.

9. Changes

We reserve the right to change this privacy policy. The most current version is always available on our websites. In the event of substantial changes, we will inform you via our website or, if possible, by email.

11. Applicable Law and Competent Court

Dutch law applies to this privacy policy. To the extent legally permitted, disputes are subject to the exclusive jurisdiction of the Rotterdam District Court, unless mandatory consumer protection rules determine otherwise.
